The Iowa Racing and Gaming Commission (IRGC) met at the Drury Inn in West Des Moines, Iowa.  Commission members present were Kris Kramer, Chair; Carl Heinrich, Vice Chair; and members Julie Andres, Pennie Gonseth Cheers and Jeff Lamberti.

APPROVE AGENDA: Chair Kramer called the meeting to order at 10:00 AM.  She advised Commission staff had received a request to withdraw Agenda Item 3E, and requested a motion to approve the agenda as amended.  Commissioner Heinrich moved to approve the agenda as amended.  Commissioner Gonseth Cheers seconded the motion, which carried unanimously.

ANNOUNCEMENTS: Chair Kramer called on Brian Ohorilko, Administrator of IRGC, for announcements.  Mr. Ohorilko provided the following information regarding future Commission meetings:

  • August 22, 2019 – Riverside Casino & Golf Resort, Riverside (Submissions due by August 8, 2019)
  • No Meeting in September
  • October 3, 2019 – Isle Casino Hotel Waterloo, Waterloo

Mr. Ohorilko advised Commission staff would be sending out a meeting schedule for all applicants of casino sports licenses, on-site vendors, advanced deposit sports wagering operators and fantasy sports contest providers.  The meetings are intended to go through each application, controls submitted and any outstanding issues from the Division of Criminal Investigation.  The intent is to provide the applicants with items that still need to be addressed prior to the commencement of sports wagering.  The meetings will be held in the order in which the applications were received. 

CONTRACT APPROVALS   (OSV – OUT OF STATE VENDOR; RP – RELATED PARTY):

Dubuque Racing Association, Ltd.: Brian Rakestraw, General Manager, presented a contract with IGT for equipment, software and services for both retail and mobile sports betting. 

Hearing no comments or questions, Chair Kramer requested a motion. Commissioner Lamberti moved to approve the contract as submitted.  Commissioner Andres seconded the motion, which carried unanimously.

Ameristar Casino Council Bluffs, LLC: Paul Czak, General Manager, presented the Advanced Deposit Sports Wagering Operator Agreement with Penn Sports Interactive, LLC to run mobile sports betting.

Hearing no comments or questions, Chair Kramer requested a motion.  Commissioner Heinrich moved to approve the Advanced Deposit Sports Wagering Operator Agreement as submitted.  Commissioner Gonseth Cheers seconded the motion, which carried unanimously.

Diamond Jo, LLC: Wendy Runde, General Manager, presented an Advanced Deposit Sports Wagering Operator Agreement with Betfair Interactive/FanDuel.  She advised Boyd Gaming has a national contract with Betfair Interactive, more commonly known as FanDuel.  Ms. Runde stated FanDuel made its splash as a fantasy sports operator in 2009, but have emerged as one of the leading sports betting providers in the United States.  FanDuel operates the sportsbook at The Meadowlands in New Jersey, which has consistently been the number one sportsbook in the state since sports betting was legalized in 2018.  They currently operate one sportsbook in Pennsylvania and two in Indiana, with more states to follow. 

Hearing no comments or questions, Chair Kramer requested a motion.  Commissioner Lamberti moved to approve the Advanced Deposit Sports Wagering Operator Agreement as submitted.  Commissioner Heinrich seconded the motion, which carried unanimously.

Ms. Runde presented a contract with Betfair Interactive/FanDuel for a retail sportsbook services agreement.

Hearing no comment or questions, Chair Kramer requested a motion.  Commissioner Andres moved to approve the contract as submitted.  Commissioner Gonseth Cheers seconded the motion, which carried unanimously.

Diamond Jo Worth, LLC: Scott Smith, General Manager, presented an Advanced Deposit Sports Wagering Operator Agreement with Betfair Interactive/FanDuel.

Hearing no comments or questions, Chair Kramer requested a motion. Commissioner Heinrich moved to approve the Advanced Deposit Sports Wagering Operator Agreement as submitted.  Commissioner Andres seconded the motion, which carried unanimously.

Mr. Smith presented a contract with Betfair Interactive/FanDuel for a retail sportsbook services agreement.

Harveys Iowa Management Company, LLC: Samir Mowad, General Manager, presented an Advanced Deposit Sports Wagering Operator Agreement with Caesars Interactive Entertainment, LLC, a subsidiary of Caesars Entertainment, to be the advanced deposit sports wagering provider for their online offering and sports betting.

Hearing no comments or questions, Chair Kramer requested a motion.  Commissioner Andres moved to approve the Advanced Deposit Sports Wagering Operator Agreement as presented.  Commissioner Gonseth Cheers seconded the motion, which carried unanimously

Iowa West Racing Association d/b/a Horseshoe Casino: Mr. Mowad presented an Advanced Deposit Sports Wagering Operator Agreement with Caesars Interactive Entertainment, LLC.

Hearing no comments or questions, Chair Kramer requested a motion.  Commissioner Lamberti moved to approve the Advanced Deposit Sports Wagering Operator Agreement as presented.  Commissioner Andres seconded the motion, which carried unanimously.

Mr. Mowad presented a contract with PSX-Inc. for A/V Equipment for the Sportsbook remodel.

Hearing no comments or questions, Chair Kramer requested a motion. Commissioner Lamberti moved to approve the contract as submitted.  Commissioner Heinrich seconded the motion, which carried unanimously.

RULES: Mr. Ohorilko advised the rule package before the Commission is filed for Emergency Adoption, and is intended to enact Senate File 617, which authorized sports wagering and fantasy sports contests in Iowa.  The rule making is intended to provide a framework and guidance to all industry participants and protect the public and assure the integrity of licensed facilities and participants.  The emergency amendments reconcile existing rules with the new legislation and also provide two new chapters of rules, chapters 13 and 14.  Mr. Ohorilko stated that if the rules are adopted today they would become effective on or about July 30, 2019 with wagering and contests to begin no earlier than August 15th at 12:00 PM.  He requested approval of the emergency rule package.

Hearing no comments or questions, Chair Kramer requested a motion.  Commissioner Lamberti moved to approve the emergency rules as presented.  Commissioner Gonseth Cheers seconded the motion, which carried unanimously.

SELF-EXCLUSION RESOLUTION: Mr. Ohorilko stated this resolution goes hand-in-hand with the rules just adopted.  It is intended to update the Iowa Voluntary Self-Exclusion Program expectations and requirements for the facilities, the advanced deposit sports wagering companies and the fantasy sports providers.  He advised the resolution has been submitted to the industry.  Staff did receive a few comments, and some issues have been addressed.  Mr. Ohorilko requested approval of the amended resolution.

Hearing no comments or questions, Chair Kramer requested a motion.  Commissioner Heinrich moved to approve the Resolution for the Iowa Voluntary Self-Exclusion Program as amended.  Commissioner Andres seconded the motion, which carried unanimously.

SPORTS WAGERING LICENSE: Chair Kramer stated the Commission has accepted the applications and has received updates from Commission staff on the applications.

Ameristar Casino Council Bluffs, LLC: Mr. Czak requested approval of their sports wagering license application.

Hearing no comments or questions, Chair Kramer requested a motion.  Commissioner Gonseth Cheers moved to grant the license to conduct sports wagering to Ameristar Casino Council Bluffs, LLC conditioned upon the satisfactory completion and approval of controls pursuant to Iowa Administrative Rules Chapter 491 and written authorization from the Commission Administrator or designee to accept wagers.  Commissioner Lamberti seconded the motion, which carried unanimously.

Catfish Bend Casinos II, LLC: Rob Higgins, General Manager, requested approval of their sports wagering license application.  Representatives from PointsBet were also in attendance to answer any questions.

Commissioner Heinrich moved to grant the license to conduct sports wagering to Catfish Bend Casinos II, LLC conditioned upon the satisfactory completion and approval of controls pursuant to Iowa Administrative Rules Chapter 491 and written authorization from the Commission Administrator or designee to accept wagers.  Commissioner Lamberti seconded the motion, which carried unanimously.

Diamond Jo, LLC: Ms. Runde requested approval of their sports wagering license application.

Grand Falls Casino Resort, LLC: Dan Franz, General Manager at Riverside Casino & Golf Resort, LLC, requested approval of the sports wagering license application on behalf of Grand Falls Casino Resort, LLC.
